Refund Policy
How cancellation, withdrawal and refunds work for paid VMSProbe subscriptions. This policy forms part of the Terms of Service under Article 9; where applicable law is more favourable to you, the law applies. This English text is a translation of the Korean original. If the two differ, the Korean version prevails.
1. Scope and seller
(1) This policy applies to monthly and yearly subscriptions to the paid plans (Solo, Team, Integrator) purchased at vmsprobe.com. The Community plan is free, so there is nothing to refund.
(2) Paid subscriptions are sold by Paddle.com Market Limited ("Paddle") as merchant of record, and Paddle also processes payments and refunds. Paddle's Buyer Terms also apply to the payment; where they are more favourable to you than this policy, they apply.
(3) The Enterprise plan and offline licences follow the refund terms of their separate agreement.
2. You can cancel at any time
(1) You may cancel your subscription at any time, with no penalty or cancellation fee.
(2) Cancelling stops billing from the next billing date, and you keep the paid plan until the end of the period already paid for. At the end of that period your organization moves to the Community plan.
(3) Cases already stored are not deleted when you move to the Community plan, but the free plan's limits apply (the number of findings visible, no AI explanations, and so on).
3. Withdrawal within 7 days of payment
(1) If, within 7 days of a payment (including an automatic renewal payment), you have not used any paid feature during the period that payment started, the full amount is refunded. This applies to both monthly and yearly billing.
(2) "Used a paid feature" means that during that period you generated an AI explanation, viewed analysis results beyond the free plan's limits (such as the third and later findings), or used a feature available only on paid plans. Merely signing in, or using only features also available on the free plan, does not count as use.
(3) Because the Service is digital content, withdrawal may be restricted under Article 17(2) of the Act on Consumer Protection in Electronic Commerce once paid features have been used. For this reason the Company lets you try the Service on the Community plan before paying, and states this restriction at checkout and in this policy.
(4) If the Service differs from how it was described or advertised, or from the contract, you may withdraw within 3 months of receiving it, or within 30 days of the day you learned or could have learned of the difference.
4. Refunds on cancellation mid-term
(1) Monthly subscriptions: unless section 3 applies, the month already paid for and in progress is not refunded. After cancelling you can use the Service until the end of that month.
(2) Yearly subscriptions: if you cancel more than 7 days after payment, the months you have used are settled at the monthly list price and the remainder is refunded. That is, refund = amount paid − (months used × monthly list price); if the result is zero or less, there is no refund. Any month used for even a day counts as a whole month.
(3) Used months are settled at the monthly list price because the yearly price is a discount that assumes 12 months of use. No penalty is charged beyond this settlement.
(4) When a yearly subscription is cancelled with a refund, the paid plan ends when the refund is processed.
5. Refunds for reasons on our side
Regardless of sections 2 to 4, we refund:
- if the Service was unavailable for 72 consecutive hours or more for reasons attributable to the Company: a pro-rated refund for the period you could not use it;
- if the Company discontinues the paid service: a pro-rated refund for the remaining paid period;
- if a billing error such as a double charge is confirmed: the full amount charged in error.
6. Requesting a refund
(1) You can request a refund directly through the link in Paddle's payment confirmation e-mail (or at paddle.net), or by e-mailing support@vmsprobe.com with your account e-mail address and the payment details (order number).
(2) We will tell you within 3 business days of receiving the request whether a refund is due and how much, and once a refund is approved it is made through Paddle to the payment method you used. Depending on your card issuer or payment method, it may take 5 to 10 business days to appear.
(3) The refund includes the corresponding share of the tax charged at payment. Because of exchange rate movements or card issuer fees, the amount shown in your currency may differ from what was charged; neither the Company nor Paddle can control this.
(4) If you ask your card issuer to reverse a payment (chargeback) without going through the refund process, the Company may suspend the paid features of that subscription until the dispute is resolved.
7. Statutory rights
This policy does not limit the right of withdrawal under the Act on Consumer Protection in Electronic Commerce, the right to terminate continuous transactions under the Door-to-Door Sales Act, or any other right applicable law guarantees to consumers. Where applicable law or Paddle's Buyer Terms are more favourable to you than this policy, they apply.
